Privacy Policy

wllpower llc (“wllpower,” “Company,” “We,” “Us,” or “Our”) respects Your privacy. This Privacy Policy explains how We collect, use, disclose, retain, and protect information when You use wllpower.com (the “Website”) or Our personal training, local virtual support, and nutrition coaching services (the “Services”). The Website is informational and is not used to complete purchases. Services are currently offered only to clients located in North Carolina, primarily in the greater Research Triangle area.

1. Key Definitions

“Personal Data” or “Personal Information” means information that identifies, relates to, describes, or could reasonably be linked to an identified or identifiable person.

“Health Information” means information relating to Your health, medical conditions, medications, injuries, limitations, pregnancy or lactation status, fitness status, nutrition, food logs, body measurements, progress assessments, physician clearances, or similar matters that You provide in connection with the Services.

“Service Provider” means a vendor or contractor that processes Personal Data on Our behalf, such as Our Website host, forms provider, payment processor, scheduling provider, e-signature provider, communications provider, or professional adviser.

2. Information We Collect

Contact and inquiry information. If You contact Us through the Website contact form, email, telephone, text message, or in person, We collect the information You choose to provide, such as Your name, email address, phone number, and message.

Client intake and Health Information. If You move toward becoming a client, We collect information through Our new client form, health-screening questionnaire, physician-clearance documents, food logs, progress assessments, body or fitness metrics, and communications with Our trainers or nutrition coaches. This may include medical conditions, medications, injuries, physical limitations, family medical history, pregnancy or lactation status, nutrition goals, dietary practices, exercise history, and emergency contact information if requested.

Payment and client-record information. Purchases are not made through the Website. If You become a client, payment is arranged through the Coaching Agreement process. We collect package, program, payment, receipt, and client-record information needed to administer the Services. Full payment-card numbers are processed by Our payment processor and are not stored by Us.

Limited technical information. wllpower does not use analytics tools, advertising pixels, retargeting pixels, or behavioral tracking. The Website is hosted on Cloudflare Pages, and Cloudflare may process limited technical information for ordinary website operation, security, delivery, and bot mitigation, such as IP address, device or browser type, requested pages, date and time of access, and security or error logs.

3. Hosting, Forms, Cookies, and Tracking

We do not use analytics tools, advertising pixels, retargeting pixels, cross-context behavioral advertising tools, or similar tracking technologies on the Website. We do not sell Personal Data or Health Information and do not use it for targeted advertising.

Cloudflare may set strictly necessary cookies or use similar technical measures for security, bot mitigation, and reliable Website delivery. These are not used by wllpower for analytics or advertising.

Our contact form and new client intake form are provided through Tally (Tally BV). When You open or submit a Tally form, Tally processes the information You enter and may apply its own cookies or technical measures on its form pages. Tally’s privacy and cookie materials apply to Tally form pages in addition to this Privacy Policy.

We provide a link to this Privacy Policy at or before the point where You submit information through Our forms. If We later add analytics, advertising tools, or similar tracking technologies, We will update this Privacy Policy and provide any notices, consent mechanisms, or opt-out choices required by applicable law before using them.

4. How We Use Information

We use Personal Data to respond to inquiries; evaluate whether Services can be provided safely; design, schedule, personalize, and administer personal training, local virtual support, or nutrition coaching programs; arrange and record packages, payments, receipts, cancellations, refunds, and legal notices; communicate about appointments, safety, service updates, and client records; maintain security and prevent misuse; comply with legal, accounting, insurance, dispute-resolution, and recordkeeping obligations; and carry out any other purpose disclosed at collection or with Your consent.

5. Health and Sensitive Information

We use Health Information only for Services, client safety, service-related communications, recordkeeping, legal compliance, insurance and dispute needs, and other purposes You authorize. We do not use Health Information for targeted advertising, retargeting, unrelated marketing, or sale.

We limit access to Health Information to personnel who need it to provide or support the Services. The new client form and health-screening questionnaire are collected through Tally, which acts as a Service Provider processing the information on Our behalf under a data processing agreement. After the information is transferred into wllpower’s client records, We delete the corresponding response from Tally. Brief residual copies may remain in Tally’s routine backups for a limited period before being overwritten or deleted in the ordinary course.

6. How We Share Information

We share Personal Data only in limited circumstances: with Service Providers that help Us operate the Website and Services, including Cloudflare, Tally, payment processing, scheduling, e-signature, communications, SMS and email, security, and professional services; to comply with law or valid legal process; to enforce agreements, protect rights and safety, or detect and prevent fraud or security incidents; in connection with a merger, acquisition, reorganization, financing, bankruptcy, or sale of assets, with notice if Your Personal Data becomes subject to a materially different privacy policy; and at Your direction or with Your consent. We do not sell Personal Data or Health Information, and We do not share it for targeted advertising.

7. Retention

We retain Personal Data only as long as reasonably necessary to provide the Services, maintain records, comply with legal obligations, resolve disputes, enforce agreements, and protect rights and safety. Health Information is retained only as long as needed for Services and legal, accounting, insurance, dispute-resolution, and recordkeeping purposes, after which it is deleted, anonymized, or de-identified where feasible. wllpower maintains a written retention schedule for client files and Health Information.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Data from unauthorized access, use, disclosure, alteration, or destruction. These may include access controls, limiting access to intake responses, vendor review, confidentiality obligations, and reasonable account-security practices. No method of transmission or storage is completely secure. If We become aware of a security incident requiring notice under applicable law, We will notify affected individuals, regulators, and other required parties as legally required.

9. Your Choices and Rights

You may decline to provide optional information, but some Services may then be unavailable. You may opt out of marketing emails by using the unsubscribe link or contacting Us. You may opt out of SMS or text messages by replying STOP, where applicable. Consent to promotional texts is not a condition of purchasing Services. You may request access to certain client information as described in the Coaching Agreement and applicable law.

Some U.S. state privacy laws grant specific rights, such as access, correction, deletion, portability, or limits on the use of sensitive information. Many of those laws apply only to businesses that meet defined revenue or data-volume thresholds. Whether or not a particular statute applies, You may contact Us at the email address below to ask Us to access, correct, or delete Personal Data We hold about You, or with any privacy question, and We will respond reasonably and consistent with applicable law.

10. Children

The Website and Services are intended for adults. We do not knowingly collect Personal Data from children under 13, and the Website is not directed to anyone under 18. If You believe We collected Personal Data from a child under 13 without appropriate consent, contact Us and We will take appropriate steps to delete it.

11. Testimonials and Third-Party Websites

Testimonials shown on the Website reflect individual experiences and are not necessarily typical; results vary. Testimonials may be edited for grammar, clarity, or length and are selected by Us. We do not use a client’s name, image, likeness, before-or-after photos, or detailed health or fitness story in marketing without a separate appropriate consent or release. The Website does not sell physical products and does not currently use affiliate-marketing links. The Website may link to third-party websites, which have their own privacy practices for which We are not responsible.

12. Changes

We may update this Privacy Policy from time to time. When We do, We will revise the “Last updated” date. For material changes in how We treat Personal Data, We will post a prominent notice on the Website. Changes take effect on the date stated in the revised Policy.
